Article 123 of the Indian Constitution empowers the President to promulgate ordinances during the recess of Parliament.

Case Law:

In the case of Krishna Kumar Singh v. State of Bihar, a 7-judge Constitution bench held that unfettered re-promulgation of ordinances is not permissible.

The Supreme Court ruled that re-promulgation of ordinances undermines parliamentary legislative procedures and must be considered a violation of the Indian Constitution
