New bill:

Assam Compulsory Registration of Marriages & Divorce bill 2024 to

• Check Polygamy

• Prevent child marriages

• Prevent marriages w/o consent

Also,89 year old act to register Muslim marriages or divorce is now repealed!!

Features of now repealed 1935 law

• It was in line with the Muslim Personal Law

• State was entitled to license "any Muslim person" to register such marriages and divorces from 1995 till now!

• These Kazis or registrars enjoyed public servant status

Govternment’s justification to repeal is that, it allowed minor marriages!

Features of new act

• No role for kazis in registering marriage

• Registering officer to act if either of them are underage

• 7 conditions for registering a marriage keeping in mind age and consent

• 30 days notice before registration, objections are welcomed in these 30 days

• Provisions of act to be in addition (not derogation) of the Muslim Personal Law
