#21: SC related Articles of Constitution

A compilation of important articles you need to know!

This post will teach you important Articles related to Supreme Court of India.

Article 124: Establishment & Constitution of SC

This article gives:
- strength of SC (currently 34)
- appointment by President
- Qualification to be a judge
- Removal of a judge
- Oath and post retirement restrictions

Article 129: Court of Record & Contempt

This article gives:
- SC to be a court of record
- Powers to punish for its contempt of itself (2 types of contempt: criminal & civil)

Article 130: Seat of SC

This article gives:
- SC shall sit in Delhi
- CJI, with President's approval, may appoint some other place as seat of SC

Article 131: Original Jurisdiction in matters of

- Centre and states
- Centre and states on one side and state(s) on other
- States and states
Any matter between them, SC has original jurisdiction

Article 132: Appellate jurisdiction

An appeal lie to SC from any judgement of any HC:
- in civil or criminal cases
- if certifies that case involves 'substantial question of law'
- case requires interpretation of constitution

133/134 about civil/criminal appeal in SC from HC

Article 136: Special Leave to Appeal (SLA)

SLA from any judgement, sentence or order of any:
- court
- tribunal
- relevant authority

Article 137: Review of judgements of SC

SC can self review its judgement.

Article 141: Law declared by SC to be binding on all courts

SC's judgements are sort of precedent for all lower courts to abide by!

Ye judgements apne aap me hi ek kanoon ki tarah hoti hai.

Article 143: Powers of President to consult SC

- The advice is non-binding on President
- SC can refuse to give advice.
