Jan Vishwas Bill
• Aim: Boost ease of living and ease of doing business
• Amends 183 provisions to be decriminalized in 42 central acts administered by 19 Ministries/Departments
• The amendments are in sectors like agri, environment, media and health (Some bills amended are)
- Drugs & Cosmetics Act 1940
- Food Safety and Standards Act 2006
- Pharmacy Act 1948
• Several fines converted to penalties reducing judicial burden and removing imprisonment provisions
Issues with amendments
Drugs and Cosmetics Act 1940 is most contentious
• It defines 4 categories of offences:
a) Adulterated drugs
b) Spurious drugs
c) Mislabelled drugs
d) Not of Standard Quality Drugs (NSQ)
• The amendment
a) Adds provisions for NSQ manufacturers to escape significant penalties
b) Reduces penalties for pharmacy owners violating license terms
Govt response to this (Health Minister Statement)
