Rajasthan assembly passed the Rajasthan Platform Based Gig Workers (Registration & Welfare) Bill 2023. First of its kind, what do you need to know about it for #UPSC CSE

Details of the bill

a) Bill applies to 'aggregators and' 'primary employers'
- Aggregators: Digital intermediaries connecting buyers and sellers
- Primary employers: Individual or organizations engaging platform based workers

b) Proposes welfare board

Comprising
- State officials
- 5 representatives each from gig workers/aggregators
- 2 others from civil society

Purpose

- Set up Social Security and Welfare Fund
- Register platform based gig workers, aggregators & primary employers
- Facilitate guarantee of social security to platform-based gig workers
- To provide for matters connected therewith or incidental thereto
- Maintain database of the companies & workers
- Give unique ID to every worker (valid in perpetuity)
- To formulate schemes for social security, listing only accidental & health insurance

Source of funds

The Social Security and Welfare Fund
- Contributions from individual workers, state govt aids, welfare cess
- Aggregator to pay cut from each transaction (1-2%)

Other details

- Any person who joins an app based platform (regardless of duration) has right to be registered

Grievances of workers

- Will be heard for grievances related to entitlements, payments/benefits etc. in the act
- Petition can be filed online or through web portal
- '90 days' time to employer to object to order in front of Appellate aurthority

Aggregator duties under the bill

- Deposit cess on time
- Update database of gig workers
- Document variations in numbers within one month of such changes
- Fine of 5 lac for first offence & 50 lac for further violations for aggregators
- For primary employers, 10k for first offence fine and 2 lac for later violations
